Building Permits

Permits are required for construction of all new buildings/structures, additions to buildings/structures, interior remodels/alterations that include structural modifications, structural repairs to buildings, storm shelters, covered decks, covered patios, storage buildings, carports, fences, swimming pools, demolition of structures, cell towers, mechanical work, and any plumbing or electrical work with the exception of changing fixtures.

Cosmetic work such as painting, tiling, carpeting and replacing cabinets do not require a permit. However, you are encouraged to contact the City of Heber Springs Planning & Zoning office at (501)362-8303 before beginning any work to determine whether or not permits are required.

Permits can be obtained by visiting the Planning & Zoning Division of the Heber Springs Fire Department located at 1001 W Main St or you can also fill out an online permit application located on our website

Any property owner or authorized agent of the owner may apply for the permit. Trade permits (Plumbing, Electrical, Mechanical, etc) are required separate from building permits and should be requested by the contractor completing the work.

For all new construction and additions, we will require a site plan and a set of plans (including elevations, floor plans, plumbing, and electrical). For remodels we will require a before and after floor plan of the entire house. It must have rooms labeled, show doors and windows with sizes and show where any electrical (include smoke detectors) or plumbing will be added or moved.

A site plan is an overview of your entire property and should include all existing structures, lot dimensions, proposed improvements and the distance from those improvements to your property lines.

If you own the property and it is your main place of residence, then you can do any building, plumbing, electrical or mechanical work yourself. You are still required to obtain permits as that work will have to be inspected and the work must be completed by you. If you hire someone else to perform the work they will need to pull the permit. You are responsible as the permit holder that all work completed meets the building code requirements. 

The City of Heber Springs does not have jurisdiction outside of the city limits. If you live outside the city limits, Cleburne County does not require permits, but if you are required to have documentation for a lender or insurance, please refer to Ordinance 2021-005 enacted by the Quorum Court of Cleburne County.

The City of Heber Springs does not locate property lines. You will need to contact a surveyor to locate those or you can try to find them yourself. Most surveyors will pin the corners of the property and also mark an area for set-back requirements.  

A permit is valid for 1 year as long as work is receiving inspections. Extensions can be requested and may be granted upon the authorization of the building official, otherwise they will be required to be re-permitted with fees due.

Inspections can be scheduled by calling our office at 501-362-8303 or if the permit was obtained online a you may request an inspection on our website. Inspections will be scheduled between the hours of 8:30am – 4:00pm daily. We require a minimal of 24hr notice on all framing, gas/electric services and final inspections – these rules also apply when scheduling online.

No. Only an emergency that happens after hours or over the weekend can proceed without a permit, but you are required to obtain a permit the next business day.  It is strongly recommended to apply for a permit using our permit portal prior to any work being started.  Work conducted without a permit will be subject to a Stop Work Order or Notice of Code Violation and a penalty fee will be applied when the permit is issued per City Ordinance.

Where equipment replacements and repairs must be performed in an emergency situation, the permit application shall be submitted the next working business day to the building official. Yes, for any new construction a permit is required. Inspections will depend on the type of structure. Please call the Building Inspector at 501-362-8303 if you have any questions.

Plans are needed for any and all changes to the original structure that may affect the structural, electrical, plumbing or mechanical aspect of the building.

Yes, however this practice is strongly discouraged as the signature on the application and permit indicates the person or company responsible for the work and it is meeting the intent of the code.

If you are replacing an existing fence with new materials, for example a chain-link fence with new chain-link materials or replacing the boards on an existing privacy fence, then no a permit is not required.  If you are changing the fence material/style completely, then a permit is required. 

Replacement of shingles or roofing materials does not require a permit, however if you are replacing any or part of the decking you will need a permit.

Yes, a permit is required when any type work is done that affects the city water supply and we want to ensure that the flow of sewer waste is such that there are no problems in the future.

Yes, we want to ensure that there is a reduced pressure zone (RPZ) connected to the irrigation line with a cut-off value to ensure that no ground water can be siphoned back into the city water system.

If structure elements are uncovered and found to be unsound or otherwise structurally deficient, then a permit is needed and such elements shall be made to conform to the requirements for new structures.

If tearing down or adding any structural walls a building permit will be needed. If electric or plumbing will be added to a new area these permits will be needed also.

A permit is not required to replace a vanity, sink, toilet, etc., however if tearing down or adding any structural walls a building permit will be needed. If electric or plumbing will be moved or added to a new area these permits will be needed also.

No, you do not need a permit for this type of work, however if any structural repairs to sub floor and floor joist are required, then a building permit will be needed.
